PUBLIC OFFER AGREEMENT

for Digital Services

1. General Provisions

1.1. This Agreement constitutes a public offer in accordance with Articles 633, 641, 642 of the Civil Code of Ukraine and the Law of Ukraine “On Electronic Commerce.”

1.2. Acceptance of this Offer occurs upon payment via Portmone and/or confirmation of agreement by checkbox.

1.3. From the moment of Acceptance, this Agreement is deemed concluded electronically.

3. Subject of the Agreement

3.1. The Service Provider grants access to digital informational and analytical services, including:

  • online freight rate calculators;
  • reference tools for distances and voyage duration;
  • analytical information for professional use.

3.2. Services are provided exclusively in electronic form.

 

4. Access to the Services

4.1. Services are provided as time-limited digital access.

4.2. Access period and price are stated on the payment page.

4.3. Access is activated immediately after successful payment.

4.4. A 3-hour trial access may be provided for evaluation.

 

5. Price and Payment

5.1. Prices are displayed on the payment page.

5.2. Payments are processed via Portmone in compliance with PCI DSS.

5.3. The Service Provider does not store payment card data.

 

6. Refund Policy

6.1. General Rule

No refunds are issued after access activation, except in the cases listed below.

6.2. Refund-Eligible Cases

Refunds may be granted only if:

  • the Service cannot be used due to a technical issue caused by the Provider;
  • a duplicate payment was made;
  • the Service was not provided or was materially incorrect;
  • required by applicable law or payment system rules.

6.3. Refund Method and Timing

6.3.1. Refunds are processed to the same payment method used for payment.
6.3.2. Refund period: up to 10 banking days.
6.3.3. Payment system fees may be non-refundable.

6.4. Non-Refundable Cases

Refunds are not provided for:

  • expired trial access;
  • unused services;
  • subjective dissatisfaction;
  • user-side technical issues.

 

7. Rights and Obligations

Users shall not transfer access or misuse the Service.
The Provider may restrict access in case of violations.

 

8. Limitation of Liability

Services are provided “as is.”
The Provider is not responsible for business decisions based on the Service.

 

9. Personal Data

Personal data is processed in accordance with Ukrainian law and the Privacy Policy.

 

10. Term

The Agreement is valid for the duration of the paid access period.

 

11. Governing Law

This Agreement is governed by the laws of Ukraine.
